Terms and Conditions of Contract
1) All business transactions are subject to these conditions which are deemed to have been accepted by all parties involved.
2) Simon Lindsay representing www.utahdreams.com hereinafter will be referred to as “www.utahdreams.com”. All owners and agents will be referred to as “the Agent”. All persons who make enquiries or bookings through www.utahdreams.com will be referred to as “the Client”.
3) It is the responsibility of the Agent to ensure his/her clients are aware and agree to these terms and conditions where appropriate to them.
4) This contract is for the purpose of offering paid accommodation to clients on request in designated accommodation in Utah, USA and in other locations as agreed between www.utahdreams.com and the Agent.
5) www.utahdreams.com does reserve the right to reject any proposals for advertising.
6) www.utahdreams.com agrees to advertise via its website, internet or other media, on a free or paid fee basis (based on current advertised rates) – subject to review on an annual basis, any accommodation represented by the Agent.
7) The fee will cover advertising on the website following review and publishing of any listing.
8) The fee will be due via PayPal. In the event the fee is not received within one calendar month of the receipt of the initial property details uploaded to the site, the advertised property or properties will be permanently removed from the site and the Agent details deleted.
9) www.utahdreams.com does not accept any liability for any errors, misrepresentation or out of date information. It will remain the responsibility of the Agent to ensure all material supplied is correct, legal and up to date. All published material by www.utahdreams.com will be available on the website for the Agent to ensure accuracy.
10) All complaints or claims will not be entered into by www.utahdreams.com and will remain the responsibility of the Agent.
11) All properties will be advertised at the Agent’s agreed rate(s).
12) www.utahdreams.com is acting purely as an advertising portal on behalf of the Agent and will not accept any liability for cancellations of any kind on the part of the Agent or the Client.
13) No liability will be accepted by www.utahdreams.com for any loss, damage or injury howsoever caused in connection with any agreements or bookings entered into with the Agent or the Client.
14) It is the Agent’s responsibility to ensure all properties offered to www.utahdreams.com for the purpose of advertising conform to all legal rules or regulations governing the properties. These properties are to be fully insured for public liability and abide by any rules or regulations as designated by the relevant County or State legislation. Any properties that are found to fail to meet this criteria will be removed from the site with immediate effect.
15) All images and photographs may only be uploaded with the express consent of the owner and any copyright materials must have the express permission of the owner. All material published on the site will become the copyright of www.utahdreams.com and may not be copied, reproduced or used in any way without the prior written permission of www.utahdreams.com
16) The Clients’ personal details are not to be passed to any third party except those applicable for renting purposes. All information relating to the Agent or the Client either sent or received by www.utahdreams.com or the Agent remain private and confidential at all times. Such information may only be divulged in the event of any legal action that requires www.utahdreams.com or the Agent to release the said information.
17)www.utahdreams.com or the Agent may cancel the contract to advertise in writing giving four weeks notice unless the terms and conditions are found to be broken, in which case, the contract can be cancelled immediately. Any remaining fees for each full calendar month (pro rata) will be returned to the Agent
18) www.utahdreams.com will not accept any liability for the website being unavailable for any reason. All reasonable effort will be made to ensure the site is fully functioning and online. No refunds either full or part will be given in the event the site is unavailable for an extended period of time- up to one calendar month. If the site is intended to be unavailable for more than one calendar month or permanently removed, then www.utahdreams.com will refund all fees on a pro rata basis after the first full calendar month.
19) The Agent will be given access to the administration area of the website and must not, at any time, compromise the security of the website by divulging usernames or passwords to any third party. In the event the website is compromised through misuse of any kind by the Agent or his/her associates then www.utahdreams.com will remove the Agent and all pertaining properties from the website.
20) www.utahdreams.com reserves the right to amend these terms and conditions at any time and the latest version will be posted on the website.
